the swiss competition commission (comco) in berne has informed uefa that, on the basis of the information gathered, it considers itself to be in a position to rule on the complaint filed by swiss club fc sion on 27 october 2011, alleging that uefa had committed an abuse of a dominant position.
the secretariat of the competition commission has decided to take no action on sion's complaint, thereby reaffirming that uefa has not violated the rules of free competition and that the decisions of its disciplinary bodies represent neither an abuse of a dominant position nor an obstacle to free competition.
on 2 september 2011, the uefa control and disciplinary body imposed two match forfeits on sion for having fielded ineligible players in uefa europa league matches against celtic fc on 18 and 25 august 2011. this decision was upheld by the uefa appeals body on 13 september 2011.
the court of arbitration for sport (cas) also upheld uefa's decisions on 15 december 2011, concluding, among other things, that uefa had not committed an abuse of a dominant position as defined in the swiss cartels act
